Welcome to Match Point AI. These Terms and Conditions ("Terms") govern your access to and use of the Match Point AI WhatsApp-based service ("Service") operated by Crystalab LLP ("we," "us," "our").

By clicking "Agree" during onboarding or by using our Service, you agree to be bound by these Terms and our Privacy Policy (available at https://matchpointai.app/privacy).

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement. The Service is intended for use by members of specific, pre-vetted professional communities.

2. The Service

Match Point AI is a chatbot that collects professional information from you and uses an automated matching engine to suggest other users within your community for the purpose of professional networking.

You interact with the Service by sending and receiving messages via WhatsApp. This includes using the /start command to begin, the /stop command to opt out, and sending natural language messages (e.g., "my location is New York") which our Service will interpret to update your profile.

3. User Accounts

Your account is linked to your WhatsApp phone number. You are responsible for all activity that occurs under your account. You agree to: a) Provide true, accurate, and complete information as prompted by the questionnaire. b) Maintain and promptly update your information by sending natural language messages to the Service. c) Keep your account secure and notify us immediately of any unauthorized use.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Harass, abuse, or harm another person.
  • Aggressively promote your own products or services in a way that constitutes spam.
  • Intentionally provide false, misleading, or inaccurate information.
  • Violate any applicable law or regulation.
  • Reverse-engineer or attempt to extract the source code of our matching engine.

We reserve the right to suspend or terminate your access to the Service, without notice, for any violation of these Terms.

5. Account Termination

You may terminate this agreement at any time by sending the command /stop. This will deactivate your account, and your data will be handled according to our Privacy Policy.

We may also suspend or terminate your account if you breach these Terms or if we are required to do so by law.

6. Disclaimers and Limitation of Liability

Our Service is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied.

  • No Guarantee of Matches: We do not guarantee the quantity, quality, or suitability of any matches. We do not guarantee that a "great match" will be found.
  • No Background Checks: You are solely responsible for your interactions with other users. We do not conduct background checks, verify all user-provided information, or guarantee the identity or conduct of any user.
  • Limitation of Liability: To the fullest extent permitted by law, Crystalab LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of the Service; (b) the conduct or content of other users; or (c) any unauthorized access, use, or alteration of your data.

7. Dispute Resolution, Governing Law, and Arbitration

PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

  • Governing Law: These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
  • Binding Arbitration: You and Crystalab LLP agree to resolve any claim, dispute, or controversy arising out of or in connection with these Terms (a "Dispute") through binding arbitration, rather than in court. The arbitration will be administered by the London Court of International Arbitration (LCIA) under its applicable rules.
  • Class Action Waiver: You and Crystalab LLP agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
  • Exceptions: This arbitration clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction (e.g., to stop data theft or intellectual property infringement).

8. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide you with notice via a WhatsApp message containing a link to the new Terms. Your continued use of the Service after such notice constitutes your acceptance of the new Terms.
